الغرض من البحث إبراز دور المقاصد في معالجة الاختلاف بين الأصوليين، من خلال بيان أثر اعتبارها في قاعدة اقتضاء النهي الفساد؛ استثماراً للمقاصد، وتفجيراً لينابيعها، لتتحقق بذلك الاستفادة الكبرى من هذا العلم الجليل، وتأكيداً على العلاقة التوافقية التكاملية بين مقاصد الشريعة والقواعد الأصولية.
وقد اقتضى هذا بيان المراد بالفساد، والنهي، وعرض اختلاف الأصوليين في قاعدة اقتضاء النهي الفساد، ومآخذهم في اختياراتهم، ثم بيان المراد بالمقاصد، وأقسامها، ووجه اعتبارها في قاعدة اقتضاء النهي الفساد، وبيان القول المبني على اعتبار المقاصد في القاعدة، والقائلين به.
وقد توصَّل البحث إلى إمكانية اعتبار المقاصد واستثمارها في معالجة اختلاف الأصوليين في قاعدة اقتضاء النهي الفساد، وبناء الاختيار الأصولي في ضوئها.
The aim of the research is to highlight the role of objectives in addressing the difference between fundamentalists, by explaining the impact of considering them in the rule of requiring the prohibition of corruption. Investing in the objectives and exploding their sources, thus achieving the greatest benefit from this great science, and emphasizing the harmonious and complementary relationship between the objectives of Sharia and fundamentalist rules.
This necessitated an explanation of what is meant by corruption and the prohibition, and a presentation of the differences of fundamentalists regarding the rule that the prohibition requires corruption, and their drawbacks in their choices, then an explanation of what is meant by the objectives, their categories, and the way to consider them in the rule that the prohibition requires corruption, and an explanation of the statement based on considering the objectives in the rule, and those who advocate it.
The research has reached the possibility of considering the objectives and investing them in addressing the fundamentalist differences in the rule of necessity of prohibiting corruption, and building the fundamentalist choice in light of it.
