البيان وأحكامه – دراسة أصولية The Statement and Its Provisions (A Fundamental Study)

 من المعلوم أن التكاليف الشرعية لا تعرف إلا بمعرفة مصادرها وهي القرآن الكريم والسنة النبوية المطهرة. وهناك تكاليف شرعية كثيرة قد جاءت مجملة بينها الرسول ﷺ بيانًا شافيًا، فقد قال الله عز وجل في حقه﴿ وَأَنْزَلْنا إِلَيْكَ الذِّكْرَ لِتُبَيِّنَ لِلنَّاسِ مَا نُزِّلَ إِلَيْهِمْ﴾.
فالبيان من الموضوعات المهمة التي عني بها علماء الأصول؛ لما له من الفضل في توضيح ما في الألفاظ من الاطلاق، والعموم، والحقيقة، والمجاز، والنسخ، والاجمال، والاشتراك.
وهو أيضًا من الموضوعات التي تحتاج إلي التأمل والبحث؛ لكثرة النصوص الشرعية المجملة التي تحتاج في تفسيرها وبيانها إلي ضوابط؛ إما لأنها مرتبطة بنصوص أخري من الكتاب أو السنة، وإما لأنها تحتاج إلي تأمل وتدبر واجتهاد.
ولذلك تطرقت إلي تعريف المجمل والمبين، مع بيان أسباب الاجمال، يليه تعريف البيان وما يقع به، ثم أنواع البيان، وأخيرا حكم تأخير البيان سواء أكان عن وقت الحاجة، أو عن وقت الخطاب إلي وقت الحاجة.
It is known that legal costs are only known by knowing their sources, which are the Holy Qur’an and the purified Sunnah of the Prophet. There are many legal obligations, the Messenger, may God bless him and grant him peace, have provided a comprehensive explanation of them. God Almighty said regarding him: “And We have sent down to you the Remembrance so that you may make clear to the people what has been revealed to them.”
The statement is one of the important topics that scholars of fundamentals have been concerned with. Because of his merit in clarifying what is in words, such as absoluteness, generality, truth, metaphor, abrogation, generality, and association.
It is also one of the topics that requires contemplation and research. Due to the large number of comprehensive legal texts that require controls in their interpretation and clarification; Either because it is linked to other texts of the Qur’an or Sunnah, or because it requires contemplation, contemplation, and diligence.
Therefore, I addressed the definition of the general and the clear, explaining the reasons for the generality, followed by the definition of the statement and what it entails, then the types of statement, and finally the ruling on delaying the statement, whether it is from the time of need, or from the time of speech until the time of need.
