بَيْطرةُ الحيواناتِ النجسةِ والمتوحشةِ واقتناؤُها في الفقه الإسلامي Veterinary And Acquisition Of Impure And Wild Animals In Islamic Jurisprudence

البيطرة هي مداواة الحيوان من قبل المتخصصين وهي أصعب علاجا من أمراض الآدميين، وهي علم ضارب بقدمه في التاريخ، وقد اعتنت الشريعة الغراء بالرفق بالحيوان وبيطرته ورعايته جسديا ونفسيا، ومارسه النبي ﷺ بيده الشريفة، وحث على رحمة الحيوانات، والخنزير نجس العين، لكن يجوز الانتفاع بجلده بعد دبغه، وبشعره، ويجوز تربية الخنازير لإجراء التجارب العلمية عليها، ولأهل الذمة اقتناء الخنازير في دار الإسلام، وتترك الخنازير ما دامت لا تعتدي ولا تضر، والكلب طاهر العين الكلب، يجوز اقتناؤه والانتفاع به في الصيد وحراسة الزرع والماشية والبيوت، ويجوز للاستئناس به، دون الزينة واللعب، ويشرع الانتفاع بالكلاب المدربة في الاستخدامات المعاصرة، مثل كشف الجرائم وملاحقة المجرمين والكشف عن التهريب ويجوز قتل الكلب العقور، ولا يجوز قتل الكلاب المنتفع بها، ولا التي لا نفع فيها ولا ضرر، والحيوانات المفترسة وجوارح الطيور طاهرة العين، يجوز اقتناؤها بشرط أن يكون فيها انتفاع مشروع، وأن لا تؤذي الناس أو تضر بهم أو بمصالحهم، وبيطرة الحيوانات النجسة والمتوحشة خاصة المنتفع بها مأمور بها شرعا، منهي عن تعذيبها وتركها بدون بيطرة ورعاية في الحدائق المغلقة ومثلها الحدائق المفتوحة والمحميات الطبيعية، ويجوز خصاء وتعقيم الحيوانات النجسة والمتوحشة ، ولا يجوز إجراء عمليات تجميل لها، ويجوز القتل الرحيم للحيوان ، ولكن بأرحم الطرق وأسرعها وأبعدها عن التعذيب .

Islamic Sharia has taken great care of being kind to animals, veting them, and caring for them physically and psychologically. A dog is permissible to keep. It is permissible to use it for hunting, guarding crops, livestock, and homes, and it is permissible to be used for pets when needed, without adornment or play. It is permissible to use trained dogs for contemporary uses, such as detecting crimes, pursuing criminals, crime tools, and detecting smuggling. It is permissible to kill a feral dog, and it is not permissible to kill dogs that are useful to them. Which are of no benefit or harm, and predatory animals and birds of prey are pure in their eyes, it is permissible to acquire them provided that there is a legitimate use for them, and on the condition that they do not harm people or harm them or their interests, and controlling impure and wild animals, especially those who benefit from them, is prohibited by law, and it is forbidden to torture them. Leaving them without veterinary care and special care in closed gardens, as well as open gardens and natural reserves, is permissible to castrate and sterilize impure and feral animals, and it is not permissible to perform plastic surgery on them. It is permissible to euthanize the animal to make it comfortable, but in the most merciful and quickest ways and farthest from torture.
