أحكام الحضانة في ضوء الكتاب والسنة Provisions Of Custody In Light Of The Quran And Sunnah

  يتكون البحث من مقدمة، وأربعة مباحث، وخاتمة، وفهارس:
المقدمة: وتشتمل على أهمية الموضوع، وأسباب اختياره، وأهدافه، إضافةً إلى الدراسات السابقة، ومنهج البحث، وخطته.
المبحث الأول: مفهوم الحضانة ومشروعيتها
المبحث الثاني: ترتيب أصحاب الحق في الحضانة ومراحلها وشروطها
المبحث الثالث : زوال الحضانة وعودتها
المبحث الرابع: مناقشة بعض القضايا المتعلقة بالحضانة
وكان من نتائج هذا البحث:

سماحة الشريعة الإسلامية وما هي عليه من نَزاهة وموضوعية، وأنّ أحكامها صالحة للتطبيق في كل زمان ومكان.
من خلال النظر في أحكام الحضانة في الشريعة الإسلامية وجدت أن مذاهب الفقهاء فد اتفقت في بعض الأحكام واختلفت في بعضها الآخر، وأن هذه الاختلافات كانت اجتهادية تدور مع الجانب الذي يحقق المصلحة للمحضون.

أمّا أهم التوصيات فأوصي :

تَشكيل لجان اجتماعية تَنظر في البيئة الأصلح لاحتضان هؤلاء الأطفال، بعيدًا عن التطبيق الروتيني المحض تكون مشاركة للقضاء في النظر في قضايا الحضانة وإلحاق الأطفال -ذكورًا وإناثًا- بأحد الأبوين.
أن يكون هناك لجنة مُشرفة تتواصل مع المحضون على فتراتٍ مُتفاوتة من باب الاطمئنان على وضعه الاجتماعي والنفسي.

The current research consists of an introduction, four topics, a conclusion, and indexes :
Introduction: Includes the importance of the topic, the reasons for its choosing, objectives, previous studies, methodology, and plan.
First Topic: The concept of custody and its legitimacy.
The Second Topic: The arrangement of those entitled to custody, its stages and conditions
The Third Topic: The disappearance and return of custody.
The Fourth Section: Discussing some issues related to custody.
Findings of the Research:

The tolerance of Islamic Sharia, its integrity, objectivity, and its provisions are applicable at all times and places.
By examining the provisions of custody in Islamic Sharia, I found the schools of jurists agreed on some provisions and differed in others, and these differences were discretionary and revolved around the side achieves the interests of the child in custody.

Recommendations of the Research:

Forming social committees to look into the most appropriate environment for the children in custody, far from purely routine application, to participate with the judiciary in looking into custody issues and attaching children (Male and Female) to one of the parents.
There should be a supervisory committee communicates with the child in custody at varying intervals in order to check his social and psychological status.
