ضمانات حماية خصوصية العامل عَنْ بُعْدفي قانون العمل المصري رقم 12 لسنة2003 والتشريعات المقارنة Guarantees Of Protection Of Workers' Privacy Remotely In the Egyptian Labour Code No. 12 of 2003 And Comparative Legislation

أحدثت الثورة التقنية الحديثة تطورًا كبيرًا في عقود العمل وطريقة تنفيذه، وذلك باستخدام وسائل تقنية متعددة ومتنوعة فكان العمل عَنْ بُعْد أحد أهم حصاد هذه الثورة حيث سهلت هذه الوسائل طرق التواصل بين العمال والمؤسسات العمالية في جميع أنحاء العالم، وأدت إلى زيادة فرص العمل وتغيير الشكل النمطي المتعارف عليه في إبرام العقود، وفي ظل هذه التطورات ظهرت العديد من التهديدات التي قد تلحق العامل عَنْ بُعْد،  والتي من أبرزها الخصوصية وحماية بيانات العامل وحفظ حقه في حياته الخاصة الأمر الذي جعل العديد من القوانين تهتم بتطوير النصوص القانونية التي تؤكد ضمانات العامل في عقود العمل عَنْ بُعْد.
ويهدف البحث إلى دراسة مفهوم العقد وأهميته من خلال بيان الآثار الإيجابية والسلبية لهذا النمط من العمل ودراسة الحماية القانونية للعامل عن بعد من وسائل المراقبة الإلكترونية التي قد تهدد حياة العامل الخاصة من إجراء التدابير الخاصة التي تتلاءم مع طبيعته لإنشاء بيئة عمل آمنة للعمال وذويهم ، وصولا إلى مناشدة المشرع المصري بسرعة تنظيم عقد العمل عن بعد من أجل مواكبة التشريعات الدولية
The modern technical revolution has brought about a major development in employment contracts and the way in which they are implemented Through various and diverse technical means, work has been one of the most important harvests of this revolution, facilitating ways of communicating between workers and workers' institutions around the world, Increased employment opportunities and changed the common pattern of contract conclusion and, in the light of these developments, many threats that may be posed to the worker have emerged, Most notably, the protection of workers' data and the preservation of their right to private life have made many laws concerned with the development of legal texts affirming the guarantees of workers in employment contracts.
The research aims to examine the concept and relevance of the contract by demonstrating the positive and negative effects of this type of work and studying the legal protection of a remote worker from means of electronic surveillance that may threaten the worker's private life from special measures appropriate to its nature to create a safe working environment for workers and their families With a view to appealing to the Egyptian legislator to quickly organize a telecommuting contract in order to keep abreast of international legislation
