الحماية القانونية للعامل من الأخطار والأمراض المهنية في النظام السعودي ( دراسة تحليلية ) Legal Protection For Workers From Occupational Hazards And Diseases In The Saudi System ( analytical study )

في ظل التقدم والتطور التكنولوجي في كافة الميادين والمنشآت في هذا العصر، ومواجهة العامل للآلات الموجودة بالمصنع أو المنشأة، فإن العامل قد يتعرض لمخاطر وأمراض مهنية ينتج عنها آثار بالغة الأهمية سواء على الصعيد النفسي أو العضوي أو الأسري والاجتماعي، وقد أدى ذلك إلى استشراف المنظم السعودي المستقبل وتدخله لحماية العامل من هذه المخاطر والأمراض، سواء باتخاذ الوسائل الكفيلة للوقاية منها، أو بعلاجها، أو التعويض عنها، ومما يعطي هذا الموضوع أهمية كبيرة أنه يأتي في ظل التطور الكبير الحادث في المملكة العربية السعودية وكثرة إنشاء المصانع والمنشآت الإنتاجية في ظل رؤية المملكة العربية السعودية ٢٠٣٠، وتناولت هذه الدراسة هذه المخاطر والأمراض المهنية والحماية القانونية للعامل منها.
وقد اتضح من خلال الدراسة أن نجاح الحماية القانونية للعامل من المخاطر والأمراض المهنية وتحقيق أهداف العمل الآمن يعتمد بقوة على تطبيق قواعد الصحة والسلامة المهنية وعدم التهاون فيها، لذلك، يجب أن يتعاون أصحاب العمل والعمال من أجل الوقاية من المخاطر والأمراض المهنية والتنسيق مع الجهات الحكومية المعنية بذلك. ضرورة بناء الثقة بين العامل والمؤسسات الصناعية والعمالية، وتدريب العامل على استخدام كل سبل الوقاية من المخاطر والأمراض المهنية من خلال الدورات التدريبية التي تثقل مهارتهم في هذا المجال، الاكتشاف المبكر والفوري للأمراض والعلل التي تصيب العامل أثناء قيامه بالعمل. إيجاد الوسائل المعززة والتشريعات والإجراءات التنفيذية التي تحمي العامل من شأنه أن يحفز كافة الأطراف في علاقة العمل على تحقيق هذه الحماية، من أجل أن يساهم الجميع بفرصة المشاركة في بناء وتنمية المستقبل.
The current era of technological development engages workers with machines in manufacturing, exposing them to occupational hazards and diseases that result in various effects. These occupational hazards and diseases affect the workers psychologically, physically, or socially. Saudi regulator foresight these occupational effects for the future and intervene to protect the worker from these risks and diseases, whether by taking the means to prevent, treat, or compensate for them.
This article studies the worker’s legal protection, which is critical with the significant development in the Kingdom of Saudi Arabia and a large number of the establishment of factories and production facilities in light of the vision of the Kingdom of Saudi Arabia 2030. This study dealt with occupational risks and diseases and the legal protection for the worker from them.
It became clear through the study that the success of the legal protection of the worker from occupational hazards and diseases and achievement of safe work goals depends strongly on applying occupational health and safety rules and not being complacent with them. Therefore, employers and workers must cooperate to prevent occupational risks and diseases and coordinate with government agencies. Our study also identified the need to: build trust between workers and industrial and labour institutions; train workers to use all means of prevention from occupational risks and diseases through training courses that increase their skills in this field; early and immediate detection of diseases and ailments that affect the worker while he is at work. Moreover, finding enhanced means, legislation, and organizational procedures that protect workers would motivate all parties in the work environment to achieve this protection for everyone to participate in building and developing the future.
