التعسُّف في استعمال حق الحضانة The Abuse Of Right In Child Custody

لقد أولت الشريعة الإسلامية الأسرة المسلمة عنايةً بالغةً، وشملتها بأحكام تضمن لها السعادة على الدوام، وأحاطتها بسياجٍ منيعٍ يكفل للأبناء الحياة الكريمة، إلاّ أن الخلاف حين يحتدم وتنتهي العلاقة الزوجية، يحصل الخلاف بين القريب الحاضن و غير الحاضن؛ حيث يزعم كل منهما أنه الأحق بالحضانة ، والأقدر على الرعاية والتربية، مما يتسبب في التعسف في استعمال حق الحضانة، وهذا التعسف قد يقع على المحضون، وقد يقع على الحاضن، وقد يقع على القريب غير الحاضن .
ولقد اشتمل  البحث على مقدمة وثلاثة مباحث وخاتمة.
أما المقدمة : ففي أهمية البحث، وأهدافه، ومنهجه، وخطته.
وأما المبحث الأول: ففي حقيقة التعسف في استعمال حق الحضانة، ويشتمل على مطلبين: المطلب الأول: حقيقة التعسف في استعمال الحق. المطلب الثاني: الحضانة، وبعض أحكامها.
وأما المبحث الثاني: ففي التعسف في استعمال حق الحضانة تجاه المحضون، ويشتمل على مطلبين:
المطلب الأول: التعسف في حقوق المحضون المادية.
المطلب الثاني: التعسف في حقوق المحضون المعنوية.
وأما المبحث الثالث: ففي التعسف في استعمال حق الحضانة تجاه غير المحضون، ويشتمل على مطلبين:
المطلب الأول: التعسف في حقوق القريب الحاضن.
المطلب الثاني: التعسف في حقوق القريب غير الحاضن. وأما الخاتمة فتشتمل على أهم النتائج والتوصيات.
The Islamic law has given the Muslim family great care, and included provisions that guarantee it happiness at all times, and surrounded it with an impenetrable fence that guarantees the children a decent life, but when the dispute rages and the marital relationship ends, the dispute occurs between the fostering relative and the non-custodial one;  Where each of them claims that he is the most deserving of custody, and the most capable of care and education, which causes abuse in the use of the right of custody, and this abuse may occur against the child in custody, or it may occur against the custodian, or it may occur against the relative who is not the custodian.
The research included an introduction, three topics and a conclusion.

As for the first topic: in the fact of abuse in the use of the right of custody, and includes two requirements:
The first requirement: the reality of abuse of the right.
The second requirement: custody, and some of its provisions.
As for the second topic: in the abuse of the right of custody towards the fostered child, and it includes two requirements:
The first requirement: abuse of the material rights of the fostered child.
The second requirement: abuse of the moral rights of the fostered child.
As for the third topic: in the abuse of the right of custody towards the uncustodial, and it includes two requirements:
The first requirement: abuse of the rights of the custodial relative.
The second requirement: abuse of the rights of a non-custodial relative.
As for the conclusion, it includes the most important findings and recommendations.
