المقصد الشرعي وأثره في الترجيح في القضايا الفقهية المعاصرة The Legal Intent And Its Impact On Weighting In Contemporary Jurisprudential Issues

 الحمد لله، وصلى الله على سيدنا رسول الله، وعلى آله وصحبه ومن والاه. وبعد، فإن الله تعالى لم يخلقنا عبثا ولم يتركنا سدى، ومن عقل ذلك من العقلاء أدرك بعقله المقصد والحكمة من وراء الأمر والنهي في الفعل والترك أو جواز أحدهما، ونصوص الشريعة بوحييها وما ينتج عنهما من أحكام ترمي إلى علل، وحكم، ومقاصد كفيلة بأن تصل بالعقل إلى المقصد الأعظم من الخلق على مراد الله لا على ما يهواه بنظرة اجتهادية فقهية مقاصدية، أصلها في مبنى النص وفرعها في معناه، جذروها في الماضي وفروعها في الواقع، على قدر ما يعن للمرء من قضايا، وما يستحدث من وقائع. وقضايانا الفقهية المعاصرة ما هي إلا دليل حي على حيوية الفقه الإسلامي وتجدده، وخصوبة أرحام تراثه التليد والحبل السري المتصل بكل جديد، فكل قضية جديدة يتم تناولها فقهيا بالتصور الصحيح، والتكييف الفقهي تأصيلا وتدليلا؛ للخروج بحكمها الفقهي ما هي إلا مولود جديد، للفقه الإسلامي المجيد.
لذا كتبت هذا البحث بعنوان: «المقصد الشرعي وأثره في الترجيح في القضايا الفقهية المعاصرة دراسة نظرية تطبيقية مقارنة»؛ لرفع عدة مشكِلات، والإجابة عن عدة تساؤلات منها: ما المراد بالمقصد الشرعي؟ وهل يمكن اتخاذه قبلة تؤم عند الاختلاف في الترجيح؟ وما مدى إمكانية تطبيق ذلك في القضايا الفقهية المعاصرة، مثل زواج المسيار، وثبوت الجريمة بالحامض النووي وغيرها؛ للوصول إلى جملة من الأهداف والغايات التي تؤصل لاتخاذ المقصد الشرعي طريقا للترجيح في الاختلاف الفقهي المعاصر؛ للتقليل من حدته، والقضاء على روح التعصب فيه وليكون هذا طريقا جديدا ساهم هذا البحث في تعبيده.
Praise be to God، and may God's blessings be upon our master، the Messenger of God، his family، his companions، and those who followed him. And yet، God Almighty did not create us in vain and did not leave us in vain، and whoever of the wise understands that with his mind، he realizes with his mind the purpose and wisdom behind the command and prohibition in action and abandonment، or the permissibility of one of them، and the texts of the Sharia with its revelations and the rulings that result from them that aim at causes، rulings، and purposes that are capable of reaching With the mind، the greatest purpose of creation is based on God’s will، not on what he desires، with a jurisprudential view of objectives، its origin in the building of the text and its branch in its meaning، its roots in the past and its branches in reality، according to the issues that concern one، and the facts that he develops. And our contemporary jurisprudential issues are nothing but living evidence of the vitality and renewal of Islamic jurisprudence، and the fertility of the wombs of its ancient heritage and the umbilical cord connected to everything new. To come out with its jurisprudence، it is only a new born، for the glorious Islamic jurisprudence.
Therefore، I wrote this research entitled: “The Sharia Intent and Its Impact on Weighting in Contemporary Jurisprudential Issues: A Comparative Applied Theoretical Study.” To raise several problems، and answer several questions، including: What is meant by the legitimate purpose? And can it be taken as a kiss that leads when there is a difference in weighting? What is the extent to which this can be applied in contemporary jurisprudential issues، such as misyar marriage، proof of crime by DNA، and others? In order to reach a set of goals and objectives that lead to taking the legal intent as a way of weighting in the contemporary jurisprudential difference; To reduce its severity، and eliminate the spirit of fanaticism in it، and to make this a new path، this research contributed to paving it.
