خبر الواحد إذا خالف القياس عند الأصوليين The Testimony Of A Single Person If It Violates The Analogy Of The Fundamentalists

 يتناول هذا البحث مسألة أصولية مهمة ترتب عليها اختلاف في الفروع وهي " مخالفة القياس لخبر الواحد " وقد اختلفت مناهج العلماء في دفع هذه المخالفة فمنهم من قدم الخبر على القياس مطلقا ، ومنهم من قدم القياس على الخبر، ومنهم من قال بالتفصيل ، وقد تعرض البحث لبيان حقيقة المسألة فعرف كلا من القياس وخبر الواحد لغة واصطلاحا  ، وفرق بين موضوع البحث ومسألة مخالفة خبر الواحد للقياس على الأصول ، ثم حرر موضع الاتفاق ومحل النزاع بين العلماء ، وبيَّن مذاهبهم في المسألة مع ذكر أدلة كل منهم موثقا ذلك كله بالرجوع إلى المصادر الأصيلة لكل مذهب ، ثم خُتِّم ببيان أثر الخلاف في المسألة على الخلاف في الأحكام الفقهية .
وقد خلص هذا البحث إلى أن الاختلاف الواقع في المسألة والذي أدى إلى الاختلاف في الفروع  بين المذاهب لم يكن عن هوى متبع أو إنكار للخبر بل هو مبني على منهج وقواعد علمية منضبطة عند كل مذهب يحتكمون إليها وينضبطون بها ، كما أنه خلص إلى أن الصحيح من مذهب متقدمي الحنفية هو تقديم خبر الواحد على القياس مطلقا خلافا للمشهور عنهم ، وأن أكثر المذاهب تقديما للقياس على خبر الواحد هم السادة المالكية بناء على قواعدهم وأصولهم .
 This research deals with an important fundamentalist issue that resulted in a difference in the branches, which is “contrary to analogy with one report.” The methodologies of scholars differed in repelling this violation. The truth of the matter, so he defined both the analogy and the news of the one in language and idiomatically, and distinguished between the subject of research and the issue of the contradiction of the news of the one to the analogy on the fundamentals, then edited the place of agreement and the place of dispute between the scholars, and explained their doctrines in the matter with mentioning the evidence of each of them, documenting all of that by referring to the authentic sources of each doctrine Then it concluded with a statement of the impact of the disagreement on the issue on the disagreement in jurisprudential rulings.
This research concluded that the difference in the matter, which led to the difference in branches between the schools of thought, was not based on a followed whim or a denial of the news. The Hanafi applicants is to give precedence to one report on analogy at all, in contrast to what is well-known about them, and that the majority of schools that give precedence to analogy over one report are the Maliki masters based on their rules and principles.
