يهدف هذا البحث إلى إماطة اللثام عن أسلوب التغليب الذي يعد وبحق أحد عبقريات اللغة وموطن من مواطن شجاعتها غير المتناهية في التوسع في استعمال الألفاظ وربطها بالمعاني، وقد عمدت فيه إلى بحث العلاقة بين الغالب –المذكور- وعموم حكمه وشموله للمغلوب –المسكوت عنه، وأنّ المصحح لهذا الاستعمال أدوات وأدلة وشواهد اعتبار، كل هذا في إطار من الضوابط والشروط العامة وأسباب حاملة على الاستعمال، وهو وإن كان في أول النظر مبحثًا لغويًا، إلا أنه دراسة أصيلة من دراسات علم الأصول، بل إنّ درجات العلماء تتمايز بقدر الإحاطة بهذه الأساليب والمعاني، وكلما علّق المتلقي الحكم بالمعنى كان أولى بالاتباع من غيره، وتعليق الحكم بالمعنى هو أنشودة هذا البحث؛ لأنّ قراءة النصوص الشرعية بأساليبها المستعملة في معهود العرب يجعل الدراسات حول النص دراسة خصبة وحيّة تؤتي أكلها، وإلا فإنّ الدخول في دلالات النصوص دون العلم بمراميها وطريقة استعمالها سعي في ضلالة ورمي في عماية.
This research aims to unveil the style of preponderance, which is one of the linguistic genius and a source of its infinite courage in expanding the use of words and linking them to meanings. It investigates the relationship between the preponderant -the mentioned- and the generality and inclusiveness of its ruling for the subordinated -the omitted- It also shows that the corrector of this usage has tools, evidences, and considerations, all within a framework of general rules, conditions, and reasons for the usage. Although this is a linguistic topic at first glance, it is an original study from the studies of the science of Usul al-Fiqh) Moreover, the degrees of scholars differ according to their comprehension of these styles and meanings. The more the recipient attaches the ruling to the meaning, the more worthy he is of following than others. Attaching the ruling to the meaning is the goal of this research; because reading the legal texts with their styles used in the Arabic custom makes the studies on the text a fertile and lively study that yields its fruit. Otherwise, entering into the meanings of the texts without knowledge of their purposes and methods of use is a pursuit in misguidance and throwing in blindness.
