الأحكام الفقهية المتعلقة بالمهور والهدايا وأثرها في الوقاية من وقوع الطلاق في ضوء المقاصد الشرعية Jurisprudential Rulings Related To Dowries And Gifts Its Impact On Preventing Divorce In Light Of Sharia Objectives

اهتم هذا البحث بمعرفة الأسباب التي تؤدي إلى وقوع الطلاق، والوقوف على الأحكام الفقهية التي وضعتها الشريعة الإسلامية للحد من وقوع الطلاق ومعرفة المقاصد الشرعية لهذه الأحكام، ومعرفة الآثار السلبية للطلاق على الرجل والمرأة والأولاد والمجتمع، والرغبة في كتابة بحث ونتاج علمي يتناول هذا الموضوع من كافة زواياه من منظور فقهي ويكون في متناول القراء.
ولذا فقد تناولت في هذا البحث التعريف بمفردات البحث وعددا من الأحكام الفقهية التي تقي من وقوع الطلاق كالأحكام المتعلقة بالمهور من حيث حقيقة المهر وحكمه وحالات وجوبه وكذلك ظاهرة الغلاء وما يترتب عليها من أضرار وكيفية علاجها وأثر ذلك على الوقاية من وقوع الطلاق وكذلك تناولت الحديث عن الأحكام الفقهية المتعلقة بالهدايا المتبادلة بين المخطوبين وأحكام الرجوع فيها وأثرها على الوقواية من وقوع الطلاق.
 This research was concerned with knowing the reasons that lead to the occurrence of divorce, examining the jurisprudential provisions established by Islamic law to limit the occurrence of divorce, knowing the legal objectives of these provisions, knowing the negative effects of divorce on men, women, children, and society, and the desire to write research and scientific productions that address this topic from all sides. Its corners are from a jurisprudential perspective and are accessible to readers.
Therefore, in this research, I addressed the definition of the research vocabulary and a number of jurisprudential rulings that protect against the occurrence of divorce, such as the rulings related to dowries in terms of the reality of the dowry, its ruling, and the cases of its obligation, as well as the phenomenon of high prices and the harms that result from it, how to treat them, and the impact of that on preventing the occurrence of divorce. I also discussed the rulings. Jurisprudence related to gifts exchanged between engaged couples, the provisions for retracting them, and their impact on preventing divorce.
