التبعات الأدبية والتعويض عنها - فقه الأسرة نموذجاً ( دراسة فقهية مقارنة بين الفقه الإسلامي والقانون الوضعي ) Moral Consequences And Compensation For Them - Family Jurisprudence As An Example (A Comparative Jurisprudential Study Between Islamic Jurisprudence And Positive Law)

اهتمت الشريعة الإسلامية بحقوق الإنسان بصفةِ عامة وحقوقه كإنسان مسلم بصفةِ خاصة، لا سيما بين الزوجين باعتبارهما لبنة أصيلة في بناء المجتمع المسلم ودعامة قوية من دعائمه ، لذا شرع الله ـ Iـ الزواج وجعل العقد المنشئ للعلاقة بين الزوجين عقداً متيناً لا يعتريه خلل ولا تشوبه شائبة، والدليل على ذلك أن عقد النكاح قائم على الإشهار والإعلان وله مقدمات وأركان وشروط وواجبات لابد من استيفائها كلها حتى تكون العلاقة بين الزوجين خالية من أي خلل ونقيّة من أي كدر.
وبناء على ما سبق فإني أود من خلال هذا البحث دراسة الاستخدام السيء للحقوق المشروعة بين الزوجين وما يترتب عليها من أضرار نفسية ومعنوية أصبحت ظاهرة لا يغفلها أحد، إذ تنصرف الأنظار فور حدوثها للأضرار البدنية والمادية والحسية انصرافاً حصرياً ف ي الغالب منها، متجاهلين الأضرار المعنوية والنفسية الناتجة عن ذلك، وهي لمن لا يعلم لا تقل في آثارها عن الأضرار البدنية والمادية بحال إن لم تزد عنها، وقد ركزت في هذه الدراسة على عدة جوانب تُحدِث بين الزوجين ضرراً أدبياً لا يُنكر منها على سبيل المثال لا الحصر( التعويض عن الضرر الأدبي الناتج عن العدول عن الخطبة والطلاق بدون سبب والزواج بأخرى دون علم الزوجة الأولى والطلاق العلني والتشهير به عبر وسائل التواصل الاجتماعي).
Islamic law is concerned with human rights in general and his rights as a Muslim human being in particular, especially between spouses, as they are an original building block in the building of Muslim society and a strong pillar of its foundations. Therefore, God - may God bless him and grant him peace - legislated marriage and made the contract establishing the relationship between spouses a solid contract that is not afflicted by any defect or flaw. The evidence for this is that the marriage contract is based on publicity and announcement and has premises, pillars, conditions and duties that must all be fulfilled so that the relationship between the spouses is free of any defect and pure from any turmoil.
Based on the above, through this research, I would like to study the misuse of legitimate rights between spouses and the resulting psychological and moral damage that has become a phenomenon that no one ignores, as attention immediately turns to the physical, material, and sensory damage, mostly exclusively to it, ignoring the resulting moral and psychological damage. Moreover, for those who do not know, its effects are no less than, if not more than, physical and material damage. In this study, I focused on several aspects that cause undeniable moral damage between spouses, including, but not limited to, (compensation for moral damage resulting from transgression). About engagement, divorce without cause, marriage to another woman without the knowledge of the first wife, public divorce, and defamation of him through social media.
