علم أصول الفقه هو علم عظم قدره ونفعه، وعلا فخره وشرفه، إذ هو مثار الأحكام الشرعية، ومنار الأحكام الفرعية التي بها صلاح المكلفين، وهو أيضًا عمدة الاجتهاد.
ومن دقائق هذا العلم تخصيص العام، ومن المخصصات المتصلة الاستثناء، فهو من أهم أسس الاجتهاد؛ لبيان الحكم من النص المشتمل عليه؛ حيث امتازت الشريعة الاسلامية الغراء بالعموم في معظم نصوص أحكامها، فهي شاملة لجميع القضايا والأحداث وأحوال الناس، وخصصت الشريعة أحيانا هذا العموم بمخصص من المخصصات، والتي منها الاستثناء، كأحد المخصصات المتصلة عند الجمهور. والاستثناء مبحث عظيم الشأن، ذو مسائل كثيرة متعددة فكان لابد من دراسته ، ومن أهم مسائله الاستثناء الوارد بعد جمل متعاطفة علي أي جملة يعود، هل يعود إلي الجملة الأولي؟ أو إلي الجملة الأخيرة؟ أو يعود إلي الجميع؟ فكان الهدف من البحث هو الوقوف علي هذه المسألة، مع بيان الآيات القرآنية المشتملة علي الاستثناء الوارد بعد جمل متعاطفة.
The science of the principles of jurisprudence is a science of great value and benefit, and high pride and honor, as it is the subject of legal rulings, and the beacon of subsidiary rulings through which the righteousness of those responsible, and it is also the pillar of diligence.
One of the subtleties of this knowledge is the specification of the general, and among the related specifications is the exception, as it is one of the most important foundations of diligence. To clarify the ruling from the text it contains; The Islamic Sharia is distinguished by its generality in most of the texts of its rulings, as it includes all issues, events, and people’s conditions, and the Sharia sometimes allocates this generality with one of the allocations, of which the exception is, as one of the related allocations according to the general public. The exception is a major topic, with many different issues, so it had to be studied. One of its most important issues is the exception that appears after sympathetic sentences. To which sentence does it refer? Does it return to the first sentence? Or to the last sentence? Or does it come back to everyone? The aim of the research was to examine this issue, while clarifying the Qur’anic verses that contain the exception mentioned after sympathetic sentences.
