إن علم أصول الفقه من أهم العلوم الشرعية في استنباط الأحكام، ومعرفة كيفية الاستدلال بالنصوص الشرعية، وفهم مقاصدها، ومن المباحث المهمة في هذا العلم، مبحث ال: " الإجزاء"، ومن ثَمَّ استعنت بالله تعالى، وشرعت في بحثي هذا، الموسوم بعنوان: "دلالة نفي الإجزاء والقبول عند الأصوليين"، وقد قسمته إلى ثلاثة مباحث: وقد تضمن المبحث الأول التعريف بمفردات عنوان البحث، وما يتعلق بها، ثم سلطت الضوء في المبحث الثاني على دلالة نفي الإجزاء على الصحة أو الفساد، وتوظيف ذلك في بيان بعض الأحكام الشرعية التي بنيت على النصوص النافية للإجزاء عن الفعل الشرعي، وذلك من خلال بعض التطبيقات الفقهية، ثم خصصت المبحث الثالث بدلالة نفي القبول على الصحة أو الفساد، وأتبعته ببعض التطبيقات الفقهية أيضًا، ثم أردفت البحث بخاتمة بها أهم النتائج التي توصلت إليها.
The science of the principles of jurisprudence is one of the most important legal sciences in deducing rulings, knowing how to infer legal texts, and understanding their objectives, and among the important topics in this science is the study of: “Partition”, and therefore I sought help from God Almighty, and began this research of mine, which is tagged Titled: “The significance of the denial of recompense and acceptance according to the fundamentalists”, I divided it into three sections: The first section included an introduction to the vocabulary of the title of the research, then in the second section I highlighted the significance of the denial of recompense on health or corruption, and employing that in explaining some of the legal rulings that were based on On texts that deny recompense for a legitimate act, through some jurisprudential applications, then I devoted the third section to the significance of denying acceptance of validity or corruption, and followed it with some jurisprudential applications as well, then I supplemented the research with a conclusion containing the most important results that I reached.
