الرقمنة وتأثيرها علي الطبيعة القانونية للكمبيالة الإلكترونية – دراسة تحليلية Digitization And Its Impact On The Legal Nature Of The Electronic Bill (An Analytical Study)

لقد كان لثورة تكنولوجيا المعلومات ورقمنة البيانات الأثر الفعال والبالغ في في الأوراق التجارية بصفة عامة والكمبيالة بصفة خاصة ، حيث ظهور الأوراق التجارية الإلكترونية والتي من بينها الكمبيالة الإلكترونية ، تلك التي تعمل بشكل فعال علي تسهيل المعاملات التجارية وتوفير الوقت والجهد، وكونها تعد أداة وفاء وإئتمان في شكلها التقليدي ، ولكن هل تلك الوظائف تتناسب وطبيعتها الإلكترونية – فتكون الكمبيالة الإلكترونية أداة إئتمان هي الأخري – وجدنا أن الطبيعة الإلكترونية للكمبيالة الإلكترونية سواء الورقية منها أم الممغنظة – كان له من التأثير الفعال علي الوظائف الإقتصادية للكمبيالة الإلكترونية – سواء كان حالة الوفاء بها أو التظهير الناقل للملكية أو حالة الضمان الإحتياطي ، حيث كان لصمت المشرع المصري عن وضع تنظيم قانون للمعاملات الإلكترونية بصفة عامة والأوراق التجارية الإلكترونية بصفة خاصة – الأثر الفعال والواضح في عرقلة التعاملات بالكمبيالة الإلكترونية ، ولذلك حاولنا وضع مقترح مشروع قانون للكمبيالة الإلكترونية آملين من المشرع المصري أن يأخذ الأوراق التجارية الإلكترونية بصفة عامة والكمبيالة الإلكترونية بصفة خاصة بعين الإعتبار .

Ownership or reserve guarantee status, as the silence of the Egyptian legislator regarding establishing a law regulating electronic transactions in general and electronic commercial papers in particular had an effective and clear impact in obstructing transactions with electronic bills of exchange, Therefore, we tried to develop a proposed draft law for the electronic bill of exchange, hoping that the Egyptian legislator would take electronic commercial papers in general and the electronic bill of exchange in particular into consideration
