مراتب الحرام عند الأصوليين (دراسة أنموذجية على صحيح البخاري) The Ranks of The Forbidden According To The Fundamentalists (A Model Study On Sahih Al-Bukhari )

 من منطلق اهتمام الشارع بالمنهيات أشد من اهتمامه بالمأمورات، وأن هذا الاهتمام يتطلب من الإنسان دراية كافية وافية بمعرفة أقسام الحرام ومراتبه؛ جاء هذا البحث تحت عنوان: مراتب الحرام عند الأصوليين "دراسة أنموذجية على صحيح البخاري"، وقد قسمته إلى مقدمة، ومدخل مفاهيمي، وثلاثة مباحث، وخاتمة، وفهرس المصادر والمراجع، وفهرس الموضوعات.
يهدف هذا البحث إلى إبراز مكانة ومراتب نوع من أهم أقسام الحكم التكليفي، ألا وهو "الحرام"، وتوضيح الإشكالات التي قد تحدث بسبب الخلط بين مراتب الحرام نتيجة تغييب التنظير لمراتبه عن ساحة الفهم والتطبيق، وبخاصة على كتب السنة المطهرة، وعلى رأسها صحيح الإمام البخاري – رحمه الله – ، ومدى ثبوت التفاوت بين مراتب الحرام، مما كان له الأثر في التأكيد على العلاقة بين الأصول والفروع الفقهية.
Based on the fact that the Shari'a is more interested in prohibitions than in commands, and that this interest requires a person to have sufficient and comprehensive knowledge of the categories of the forbidden and their ranks; this research came under the title: The ranks of the forbidden according to the fundamentalists "A model study on Sahih Al‑Bukhari", and I divided it into an introduction, a conceptual introduction, three chapters, a conclusion, an index of sources and references, and an index of topics.
This research aims to highlight the status and ranks of one of the most important types of obligatory rulings, namely “haram”, and to clarify the problems that may occur due to confusion between the ranks of haram as a result of the absence of theorizing about its ranks from the arena of understanding and application, especially in the books of the pure Sunnah, most notably Sahih al-Bukhari - may God have mercy on him - and the extent of the proof of the difference between the ranks of haram, which had an impact in emphasizing the relationship between the principles and branches of jurisprudence.
