الأحكام الفقهية المتعلقة بمواساة غير المسلمين ( دراسة فقهية مقارنة ) Jurisprudential Rulings Related To Consoling Non-Muslims (A Comparative Jurisprudential Study)

يهدف هذا البحث إلى تسليط الضوء على قضية مهمة تمس أمن وسلامة واستقرار المجتمع ألا وهي قضية مواساة المسلمين لغير المسلمين في أوقات الأزمات والمحن وتوضيح الأحكام الفقهية المترتبة على ذلك.
وقد توصل البحث إلى العديد من النتائج، من أهمها: مواساة غير المسلمين داخلة في البر والقسط المشار إليهما في قوله تعالى: ﴿لَا يَنْهَاكُمُ اللهُ عَنِ الَّذِينَ لَمْ يُقَاتِلُوكُمْ فِي الدِّينِ وَلَمْ يُخْرِجُوكُمْ مِنْ دِيَارِكُمْ أَنْ تَبَرُّوهُمْ وَتُقْسِطُوا إِلَيْهِمْ إِنَّ اللهَ يُحِبُّ الْمُقْسِطِينَ﴾ [سورة الممتحنة: الآية: 8]"،  مواساة غير المسلمين لا تتعارض مع عقيدتنا الإسلامية، بل تأمر بها وتحث عليها، وتعتبرها من البر والإحسان المأمور بهما، المواساة تدعو إلى الألفة وتنشر المحبّة بين أفراد المجتمع،  المواساة تقوّي العلاقات بين المسلمين وبين غيرهم،  مشاركة الغير سواء أكان مسلمًا أم غير مسلم في أوقات حزنه من أعظم المواساة،  جواز مواساة المسلمين لغير المسلمين من أموال الزكاة وغيرها في أوقات الأزمات والمحن أخذًا بظاهر آية الزكاة والتي لم تفرق بين مسلم وغير مسلم،  جواز مواساة المسلم لغير المسلم بالدعاء له  لرفع البلاء عنه،  وجوب دفاع المسلمين عن أهل الذمة ورفع الظلم عنهم في حال وقوع اعتداء عليهم واعتبار أعراضهم كأعراضنا إذا كانوا من أهل بلاد الإسلام، جواز استضافة المسلم لغير المسلم في بيته في أوقات الأزمات،  جواز مواساة المسلم للمريض غير المسلم بالزيارة،  جواز قيام المسلم لجنازة غير المسلم واتباعها، جواز دفن غير المسلم مع المسلم عند الضرورة ، كما أوصى الباحث بالإكثار من الندوات التي تظهر سماحة الإسلام مع غير المسلمين والتي تنشر المحبة بين أفراد المجتمع وتقوي العلاقة بينهم.
 This research aims to shed light on an important issue that affects the security, safety and stability of society, namely the issue of Muslims consoling non-Muslims in times of crises and tribulations, and to clarify the jurisprudential rulings resulting from that. The research reached many results, the most important of which are: Consoling non-Muslims is included in the righteousness and justice referred to in the Almighty’s saying: “Allah does not forbid you from those who do not fight you because of religion and do not expel you from your homes - from being righteous toward them and acting justly toward them. Indeed, Allah loves those who act justly.” [Surat Al-Mumtahanah: Verse: 8], consoling non-Muslims does not conflict with our Islamic faith, but rather commands and urges it, and considers it to be among the righteousness and kindness that are commanded, consolation calls for harmony and spreads love among members of society, consolation strengthens relations between Muslims and others, and sharing with others, whether Muslim or non-Muslim, in their times of grief is one of the greatest Consolation: It is permissible for Muslims to console non-Muslims from zakat funds and other things in times of crises and tribulations, based on the apparent meaning of the verse on zakat, which does not differentiate between a Muslim and a non-Muslim. It is permissible for a Muslim to console a non-Muslim by praying for him to lift the affliction from him. It is obligatory for Muslims to defend the People of the Covenant and lift the injustice from them in the event of an attack on them and to consider their honor as our honor if they are from the people of the Islamic countries. It is permissible for a Muslim to host a non-Muslim in his home in times of crises. It is permissible for a Muslim to console a sick non-Muslim by visiting him. It is permissible for a Muslim to attend the funeral of a non-Muslim and follow it. It is permissible for a non-Muslim to be buried with a Muslim when necessary. The researcher also recommended increasing the number of seminars that demonstrate the tolerance of Islam towards non-Muslims, which spread love among members of society and strengthen the relationship between them.
