التقييد الإداري لأداء العبادات(الحج أنموذجًا) - دراسة فقهية مقارنة Administrative Restrictions on the Performance of Worship (Hajj as a Model) - A Comparative Jurisprudential Study

تتوق النفوس دومًا لأداء عبادة الحج؛ لما في هذه الشعيرة من روحانيات تنبع من شرف زمان ومكان المناسك. مما كان له أثر بالغ في توافد الناس؛ ليشهدوا رحمة الله-تعالى- في تلك المشاهد. لكن معلوم أن هذه الزيادة العددية لا تتحملها أماكن المناسك، مما نتج عنه كثير من المخالفات الشرعية، بل قد يؤدي في بعض الحالات إلى تلف النفس المعصومة. مما اقتضى اتخاذ ترتيبات وتقييدات إدارية من شأنها تنظيم أداء هذه العبادة؛ ليشعر الإنسان بخشوعها وسكينتها. وقد هدف البحث لبيان مدى مشروعية هذه التقييدات من منظور الفقه الإسلامي؛ لذا تناول البحث مجموعة من التقييدات الإدارية التي فرضتها الجهات المسئولة عن تنظيم شعيرة الحج. وكان من بين هذه التقييدات: التقييد باستخراج تصريح بالحج؛ للتمكن من أداء المناسك، ومدى مشروعيته.
كما أوضح البحث التأصيل الفقهي للتقييد بمنع تكرار الحج-مدة معينة- لمن حج حجة الإسلام المفروضة. والذي قد يؤدي لمزيد من أعداد الحجيج. وكذلك عرض مدى مشروعية اشتراط السلامة الصحية لمريدي الحج.
وقد اعتمدت عدة مناهج بحثية لتأصيل فكرة البحث، فاتبعت المنهج الوصفي في وصف الإشكالية محل الدراسة. والمنهج الاستقرائي المتمثل في تتبع نصوص الوحي من القرآن والسنة، فضلًا عن القواعد الفقهية المتعلقة بجزئيات البحث.
كما اتبعت المنهج المقارن في الموازنة بين مذاهب الفقهاء في المسائل محل النزاع.
وقد خلص البحث إلى أن هذه التقييدات الإدارية ليست مُعوِّقًا عن أداء شعيرة الحج، بل هي في أصلها ترتيبات تنظيمية لصيانة النفس والمال، فضلًا عن توفير السكينة والأمان للحجيج.
ويوصي البحث بالاهتمام بالدور التوعوي للجماهير بأهمية التنظيم والترتيب لعبادة الحج التي لا تتكرر في العام إلا مرة واحدة. كما يوصي بضرورة الوعي بحرمة التحايل على الأنظمة المعمول بها في تنظيم أداء شعيرة الحج.
Souls always yearn to perform the Hajj ritual, given the spirituality inherent in this ritual, stemming from the honorable time and place of the rituals. This has had a profound impact on the influx of people to witness the mercy of God Almighty in these scenes. However, it is well known that this increase in numbers cannot be tolerated within the ritual sites, resulting in many violations of Islamic law and, in some cases, even the loss of a pure soul. This has necessitated the adoption of administrative arrangements and restrictions to regulate the performance of this ritual, enabling people to experience its humility and tranquility. This research aimed to demonstrate the legitimacy of these restrictions from an Islamic jurisprudence perspective. Therefore, the research examined a set of administrative restrictions imposed by the authorities responsible for organizing the Hajj ritual. Among these restrictions was the requirement to obtain a Hajj permit to be able to perform the rituals, and the extent of its legitimacy. The research also clarified the jurisprudential basis for the restriction prohibiting repeating the Hajj—for a specific period—for those who have performed the obligatory Hajj. This could lead to an increase in the number of pilgrims. It also presented the legitimacy of requiring health and safety requirements for Hajj pilgrims.
Several research methods were adopted to establish the research concept. The descriptive approach was used to describe the problem under study, and the inductive approach was used to trace the texts of revelation from the Qur'an and Sunnah, as well as the jurisprudential rules related to the research details.
The comparative approach was also used to compare the schools of jurisprudence on disputed issues.
The research concluded that these administrative restrictions do not impede the performance of the Hajj ritual. Rather, they are essentially organizational arrangements to protect lives and property, as well as to provide peace and security for pilgrims.
The research recommends focusing on raising public awareness of the importance of organizing and arranging the Hajj ritual, which occurs only once a year. It also recommends awareness of the prohibition of circumventing the regulations in place to organize the performance of the Hajj ritual.
