مراعاة التداولية عند الفقهاء في صيغ النكاح - النكاح الأبيض أنموذجًا ( دراسة فقهية مقارنة ) Taking Into Account The Deliberativeness Of The Jurists In The Forms Of Marriage "The White Marriage As A Model" A Comparative Jurisprudence Study

أصبحت التداولية حديث الأوساط العلمية في الوقت الحاضر، وأخذ الباحثون بتناولها في مختلف العلوم الإنسانية والعربية والشرعية؛ حيث إنها يحيط بها الكثير من الغموض من ناحية تعريفها، أو الأبعاد الخاصة بها، فهي في اللغة الإنجليزية تقوم على كلمة  "pragmatic"، وهي تدل في الغالب على المنفعة العملية، وهذه المنفعة تدخل في الكثير من نواحي الحياة مما له صلة بالقصدية والسياق والعرف وغيرها، لذا تناولت هذه الدراسة موضوع: مراعاة التداولية عند الفقهاء في صيغ النكاح "النكاح الأبيض أنموذجًا"، تناولت فيها بعض المصطلحات ذات الصلة بالبحث، وهي: الإيقاعيات، والأفعال الكلامية، وسياق الحال، ومراعاة مقتضى الحال، فعرفتها في اللغة والاصطلاح، ثم ذكرت مشروعية النكاح في الإسلام مدعمة إياها بأدلة مشروعيته من القرآن الكريم والسنة النبوية والمعقول.
ثم تطرقت إلى ماهية التداولية فعرفتها في اللغة والاصطلاح، وذكرت نشأتها واتجاهاتها ومهامها وبينت العلاقة بينها وبين الفقه الإسلامي.
ثم تناولت حكم النكاح الأبيض، فذكرت فيه تعريف النكاح لغة وشرعًا، وحقيقة النكاح، وتعريف النكاح الأبيض باعتباره مركبًا، ثم ذكرت صور النكاح الأبيض، والحكم الشرعي لكل صورة منها، ثم بينت حكم انعقاد صورة النكاح الأبيض المختلف فيها بناء على تكييفها على أنها من باب نكاح الهازل في أصل العقد، ثم ذكرت مراعاة التداولية في صيغ النكاح الأبيض عند الفقهاء، حيث ذكرتُ مراعاتهم للتداولية في صيغ العقود مطلقًا ولفظ النكاح خاصةً، واتبعت ذلك بخاتمة ذكرت فيها ملخص لأهم النتائج التي تناولتها خلال البحث.
Recently, Pragmatics gained popularity in academia. Researchers began exploring it in various fields of humanities, Arabic language studies, and Shari’ah genres. However, the definition of Pragmatics is yet beyond clear, so are its various aspects. In the English language, it is based on the word “pragmatic”, which denotes practical benefit. Such a benefit intertwines with many aspects of life that are related to intentions/purposes, context, custom, and others. The present study addresses the pragmatics of the expressions of marriage in Islamic jurisprudence, “The Ruling on White Marriage as a Model”, in which the researcher addresses some basic terms, namely: deixis, speech acts, context, implicatures. These terms are firstly defined in their linguistic and technical sense. The legality of marriage in Islam is then addressed, supported by evidence of its legitimacy from the Glorious Qur’an, the Sunnah of the Prophet, and mere reason. The researcher also touches on the nature of Pragmatics, defines it, briefly covers its origin, evolution, and topics, and discusses the relationship between Pragmatics and Islamic Jurisprudence. The rule on White Marriage is then discussed, where it is initially defined both linguistically and technically, its reality is illustrated, its forms explained, and the Shari’ah ruling of each form is discussed. The ruling on the legality of disputed forms of White Marriage based on considering them versions of Nikah Al-Hazil, is also elaborated. The pragmatics of the term White Marriage among jurists is also discussed in addition to the jurists’ observance of pragmatics in the language of contracts in general and the term marriage in particular. Finally, a conclusion is provided containing a summary of key findings of the present study.
